ChurchContact is a service of ChurchlyHost, a trade name of BigHype Media LLC, a North Carolina limited liability company (“ChurchlyHost”, “we”, “us”). These terms govern the connect card service we provide to your church (“you”). By paying the setup fee you agree to them.
Your agreement is with BigHype Media LLC. ChurchlyHost is the name it trades under — not a separate company. The LLC owns the churchcontact.app domain, owns the software the service runs on, and provides the hosting.
A digital connect card, built to your branding, hosted by us at
churchcontact.app/yourfolder, delivering each submission to you by
email and, if you want one, to a Google Sheet in your own account.
The card is hosted on our infrastructure at our domain. It is not installed on your web server and does not run on your domain. You may link to it from anywhere.
The annual fee we quote you at signup is the annual fee you keep, for as long as you stay with us continuously. If we raise our prices, existing churches stay at the rate they signed at. We will not reprice you at renewal.
This survives any change to these terms. If a future version of this page shows a higher figure, your original rate still governs. Your rate is recorded in your church’s configuration and in your signup email.
If you cancel and later return, the then-current rate applies.
Further changes, structural work or new features are quoted separately.
Connect card submissions are yours. We process them on your behalf under the data processing addendum, which forms part of this agreement.
We retain an operational copy of submissions across the churches we host, in order to run and support the service. It is never sold, never used to market to your congregation, and never used for another church’s benefit. Our full obligations are in the addendum — please read it before you sign. You can ask us to switch the copy off for your church at no charge.
We host this. If your annual fee lapses, the card goes offline.
What protects you is that your data is never only in one place: every submission is emailed to you as it arrives, so your own inbox is a continuous copy that does not depend on us. You may request a full export at any time, including on your way out, and we will provide it within 10 business days. No notice period, no charge for leaving.
We do not offer a service level guarantee. This is a small service run by a small operator on commodity hosting. We aim to keep it up and we fix things promptly, but if guaranteed uptime matters to your church, this is the wrong product and we would rather say so now.
Either of us may end this agreement with 30 days’ notice. Annual fees already paid are not refunded, except where we cancel first, in which case we refund the unused months pro rata. The setup fee is not refundable once the card is built and delivered.
Do not use the card to collect information you have no lawful basis to collect, to send unsolicited bulk messages, or for anything unlawful. We may suspend a card we reasonably believe is being used that way, and we will tell you why.
We will give you 30 days’ notice by email. If you object you may cancel before they take effect and we will refund the unused portion of your year. Section 2.1 cannot be changed to your detriment.
We own the software and the domain. ChurchlyHost owns churchcontact.app, the code that runs your card, and everything we build to deliver the service, including any improvement we make while working on your card. You are buying a service, not the software.
You own your content and your data. Your church name, logo, colors, wording and every submission your card receives remain yours. You grant us permission to use them only as needed to run the service for you, and that permission ends when this agreement does.
Your card address. Your card lives at a folder on our domain. That address is provided for as long as you are a customer and does not transfer to you.
Mentioning you. By entering into this agreement you grant BigHype Media LLC permission to use your church’s name and logo to identify you as a customer, in any medium, at our sole discretion.
If you do not wish us to do so, you must notify us by letter sent through the United States Postal Service, postmarked and addressed to BigHype Media LLC d/b/a ChurchlyHost, PO Box 2044, Kings Mountain, NC 28086. We will retain your letter on file. We do not accept withdrawal of this permission by email, voicemail, text message or telephone. Until such a letter is received, permission is freely given.
The Service is provided on an "as is" and "as available" basis. The Provider does not warrant that the Service will be completely secure, uninterrupted, or error-free. The User acknowledges that they provide their data (including name, address, and phone number) at their own risk. To the maximum extent permitted by law, the Provider disclaims all implied warranties, including merchantability, accuracy of data, and fitness for a particular purpose.
To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, unauthorized access to data, identity theft, or data breaches. The Provider’s total liability for any data security incident or breach of this Agreement shall be strictly limited to the total amount paid by the User to the Provider during the twelve (12) months preceding the incident.
The User agrees to defend, indemnify, and hold harmless the Provider, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) the User's use of and access to the Service; (b) the User's violation of any term of this Agreement; or (c) the User's violation of any third-party right, including any copyright, property, or privacy right.
These terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Both parties submit to the state and federal courts located in North Carolina.
